General Terms and Conditions (AGB)
1. scope of application
These GTC govern conclusively and exclusively the legal relationship between STELP Events UG (hereinafter: STELP) and the purchaser (hereinafter: Guest) of tickets for an event organized by STELP Events. With the purchase of an admission ticket, these GTC are deemed to have been agreed.
2. conclusion of contract, availability of cards, card categories
2.1 The binding offer to conclude a contract for the purchase of tickets in the desired number and category is made by the customer. The offer obliges the customer to accept and pay for the tickets. Contracts can only be concluded online at stelp.events.
2.2 A contract including these GTC between the guest and STELP is concluded as follows: The guest enters the data required for the order (including the desired ticket category and number). STELP’s acceptance of the guest’s offer takes place exclusively by sending the invoice and then sending the tickets after receipt of payment. The decision on placement within the card categories is reserved to STELP. Order confirmations which the customer receives in text form (email) or by telephone after receipt of the order are therefore not an acceptance of such an offer, but merely inform the customer that his order has been received by STELP.
2.3 STELP reserves the right to reject the guest’s offer. This also applies in the event that the ordered ticket category or quantity is not available. In this case, the customer will be informed of the non-acceptance in writing, text form (email) or by telephone. At the same time, if tickets of a different category or in a different quantity are still available, the customer will be informed of this fact so that he can submit a new purchase offer to STELP. In principle, there is no entitlement to a specific table or seat in one of the event halls.
2.4 STELP does not offer tickets for purchase by minors. Furthermore, all tickets are only sold in normal household quantities.
2.5 The purchase of an admission ticket entitles the holder to visit all rooms on the evening of the event. There may be rooms and program items that cannot be made accessible to all visitors at the same time for capacity reasons. Compliance with the relevant official requirements is regulated and monitored by the personnel employed by STELP.
2.6 The purchase of an admission ticket does not automatically entitle the holder to attend the event. The organizer may ban persons from the premises in justified cases. These persons may be refused entry without refund of the admission fee.
3. price components, shipping costs, terms of payment, retention of title
3.1 The purchase price owed by the guest for his order is the sum of the individual prices shown for the tickets he has ordered. The price of the admission ticket already includes the statutory VAT at the applicable rate.
3.2 The purchase price is due within 7 days of receipt of the invoice. Payments are to be made without deduction to the account stated on the invoice.
3.3 The cards remain the property of STELP until they have been paid for in full. The retention of title shall also remain in force for all claims that STELP subsequently acquires against the guest in connection with the ticket purchase.
3.4 Offsetting by the guest is only permitted if his claim is undisputed or has been legally established.
4. delivery of the cards, transportation risk
4.1 Tickets shall be delivered to the delivery address specified by the guest.
4.2 Tickets will be sent out in good time before the event takes place.
4.3 If non-compliance with a delivery date is due to force majeure, unforeseen obstacles or other circumstances for which STELP is not responsible, the delivery period shall be extended accordingly.
4.4 The guest must check the tickets delivered to him/her immediately upon receipt for conformity with his/her order. In the event of incorrect delivery (wrong number, wrong seat category) and/or damage, the guest will receive a corresponding subsequent/replacement delivery against return of the incorrect and/or damaged tickets or surplus tickets will be taken back. However, this requires immediate notification of STELP (Uhlandstraße 14, 70182 Stuttgart) or by email (team@stelp.events). If no complaint is made immediately, the delivery shall be deemed to be free of defects.
5. revocation, card return
5.1 Pursuant to § 312 g para. 2 No. 9 BGB, the guest has no statutory right of withdrawal for contracts for the provision of other services in connection with leisure activities if the contract provides for a specific date or period for the provision of the service.
5.2 As a matter of principle, tickets sold cannot be taken back, with the exception of the provision in Clause 5. 4.4. Changes to the line-up of artists and bands performing at STELP Events and other changes to the event schedule do not entitle the holder to return tickets. No replacement will be provided for expired tickets. There is no entitlement to a refund of the ticket price.
5.3 The organizer is not liable if the STELP Events have to be cancelled due to force majeure or the threat of terrorist attacks or if changes to the program become necessary. Tickets and admission fees will only be returned and refunded if the STELP event has to be completely canceled and no alternative event date is planned (in particular see 5.4). However, the above reasons are excluded from this. In these cases, the claim for reimbursement expires if it is not registered within 10 days. Further claims are excluded.
5.4 If the date of the event is postponed due to stricter Corona regulations, tickets purchased will remain valid. Upon express written request, tickets and the admission price may be returned and refunded in exceptional cases. The claim for reimbursement expires if it is not registered within 10 days. 6. card loss
6.1 If an admission ticket is lost, a replacement ticket can be issued once at check-in if the visitor can prove which ticket was purchased.
6.2 If both the original ticket and a replacement ticket for the same seat are presented by different visitors, the holder of the original ticket has priority over the holder of the replacement ticket. This does not apply if the holder of the replacement card proves or credibly demonstrates that he/she is the person actually entitled to the card.
7. wardrobe
7.1 Cloakroom items (in particular coats, umbrellas, large bags and similar bulky items) must be handed in to the checkroom staff responsible. However, cash, valuables, jewelry and the like are not stored. The organizer is not liable for the checkroom.
7.2 The checkroom is organized and operated by the organizer.
7.3 The loss of or damage to items handed in to the checkroom staff and the loss of a checkroom ticket must be reported to the checkroom staff immediately.
8. lost property
Items of any kind found in the event rooms must be handed in to the checkroom staff. The loss of items must be reported to the checkroom staff. The further treatment of the lost property is governed by the provisions of §§ 978 ff. BGB.
9. domiciliary rights
9.1 STELP exercises domiciliary rights in the event rooms. STELP and its vicarious agents are therefore entitled to issue house expulsions and bans and/or take other appropriate measures within the scope of this house right. In particular, visitors to STELP events may be expelled if they disturb the event, disturb other guests and/or have violated the GTC in any other significant and/or repeated manner. Admission may be denied if the guest violates the dress code and/or there is a reasonable assumption that the guest will disrupt the STELP event or disturb other guests. The ticket price will not be refunded in these cases.
9.2 The guest may only use his designated seat. If he has taken a seat for which he does not have a valid ticket, STELP can expel the visitor from the STELP event. Item no. 9.1 sentence 4 applies accordingly.
9.3 Mobile phones, pagers and/or acoustic signaling devices of any kind may only be taken into the event rooms in such a way that the event and other guests are not disturbed.
9.4 Food and drink may not be taken into the event rooms and consumed there. It is generally forbidden to bring weapons to the event; non-compliance will result in expulsion from the event. Security personnel are authorized to carry out appropriate body searches.
9.5 Smoking is only permitted in the designated areas.
9.6 The instructions of the organizer and the staff must be followed at all times.
10. commercial resale, transfer of tickets
10.1 The commercial resale of tickets is not permitted. Access to STELP events is only possible with a ticket purchased directly from STELP.
10.2 Purchased tickets may not be passed on or resold to third parties without the written consent of STELP due to the applicable Corona regulations.
11. liability
11.1 STELP shall be liable for damages caused by its legal representatives or vicarious agents. a) are responsible and are based on injury to life, limb or health; or b) caused intentionally or through gross negligence. Otherwise, STELP, its legal representatives or vicarious agents shall only be liable for slight negligence if an obligation is breached, compliance with which is of particular importance for achieving the purpose of the contract (cardinal obligation). This liability is limited to foreseeable damages that can typically be expected to occur.
11.2 In the event of loss and/or damage to items stored in the checkroom, the liability of STELP, its legal representatives or vicarious agents is excluded. Any claims are to be addressed to the persons listed under para. 7.2 named operating company.
11.3 Attendance at the event is at your own risk.
12th raffle
12.1 Legal recourse is excluded for the raffle.
12.2 A donation receipt can be issued on request for donations in cash and/or in kind for the raffle.
13 The provisions of the Youth Protection Act apply to young people.
14. there may be a risk of possible damage to hearing and health at the event due to the volume.
15. data protection
STELP treats the guest’s personal data (name, address, telephone, e-mail, bank details) as strictly confidential. STELP shall only collect, store, process and use the data in an automated process to the extent necessary for the establishment, structuring and implementation of the contractual relationship. STELP is entitled to transmit this data to third parties insofar as this is necessary for the processing and execution of the concluded contract.
16. dispute resolution in consumer matters
Online dispute resolution: The European Commission provides a platform for out-of-court online dispute resolution (so-called OS platform) at http://ec.europa.eu/consumers/odr/. Information in accordance with the Consumer Dispute Resolution Act (VSBG): STELP is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17 Final provisions
17.1 Should individual provisions of these GTC be or become invalid in whole or in part, the remaining provisions of the GTC and the respective contract shall remain valid.18.2 There are no verbal or written collateral agreements.18.3 The law of the Federal Republic of Germany shall apply exclusively.
